In this case, both a U.S. District Court and the U.S. Court of Appeals for the Federal Circuit have ruled that the infringer is liable for all profits.
The company argued a lower court wrongly awarded Apple all of Samsung's profit on phones found to infringe Apple designs, and the court said it would attempt to resolve the issue.

Samsung's petition was supported by several tech companies looking to lessen patent damages as well as a brief from Public Knowledge and the Electronic Frontier Foundation.
Apple, based in Cupertino, and Samsung are the top two manufacturers of increasingly ubiquitous smartphones. These days, however, especially in sophisticated and complex electronic devices, a product can have multiple components that have are covered by different design patents.
Apple, in return, claimed that "The iPhone's explosive success was due in no small part to its innovative design, which included a distinctive front face and a colorful graphical user interface - features protected by US design patents".
Samsung has said in court papers that if it wins the case, it expects to be reimbursed the money it has already paid.
A smartphone contains thousands of parts, many of which are functional rather than ornamental, Samsung argues.
